Any person who wishes to access or use the Website may do so subject to acceptance of the Terms and Conditions. People who do not accept the Terms and Conditions, which are binding and obligatory for the provision of the Service, must refrain from using the Website, the Website applications and the mobile applications that are referenced to the Terms and Conditions.

These Terms and Conditions constitute a data message in accordance with Law 527 of 1999. Said data messages are generated by a computer system and do not require any physical or digital signature.

  1. Definitions: The words defined below will be understood according to the meaning established here, whether singular or plural, as long as the initial letter is capitalized:

    1. Transport Contract: It will be the land transportation contract by road bus, as defined by law, entered into by the User and the Bus Operator, who must in all cases be a company certified by the Superintendency of Transportation;
    2. Cookies: When the User connects to the Internet from their electronic device, using a browser such as Google Chrome, Mozilla Firefox or Safari, among others. Therefore, when accessing various web pages found on the Internet, and each time this happens, they send a data file called “cookie”, which, will store on your device;
    3. Payment Facilities: will be the payment gateways, the collection by the PSE button, the collection made by collectors such as, but not limited to, Baloto, Sured, payment through debit or credit cards, and any other means or mechanism that may be used. establishes to allow the User to comply with the obligation to pay for the Passenger/Ticket purchased from the Bus Operator using the Website, whose function is that of intermediation;
    4. Ibibo: Refers to the Colombian company Ibibo Group Colombia S.A.S. who is the administrator of the Website;
    5. Bus Operator: It will be the company that provides the land transportation service by road bus and that has the proper authorization from the State to act as a people transportation company. Likewise, together with the User, they constitute the parties that celebrate the Transport Contract;
    6. Ticket/Ticket: It is the travel document issued by the Bus Operator and which constitutes proof of the conclusion of the Transport Contract between the Bus Operator and the User;
    7. Person: means, depending on the context, any individual, natural person, company, association, foundation, non-profit entity of any nature, joint venture, temporary union, autonomous estate, trust, governmental authority or any other entity of any nature.
    8. Transaction: consists of the use of the means and mechanisms available on the Website so that the User complies with the payment obligation derived from the Transport Contract entered into with the Bus Operator.
    9. User: Any natural or legal person who, as the final recipient, acquires, enjoys or uses a certain product, regardless of its nature, to satisfy their own, private, family or domestic and business needs when it is not intrinsically linked to their economic activity. The concept of consumer will be understood to include that of the user.
  2. Agreement:

    These Terms and Conditions constitute an agreement between us and the User for the use of the information, software, products and/or services, among others (hereinafter, the “Services”) contained on social networks or available through the Page. , or any Ibibo application.

    These Terms and Conditions govern, among other things, the use of the Page and/or mobile application, whether as a visitor or user.

    You, as a User, are responsible for taking all measures necessary to access the Page, as well as ensuring that all persons who access the Page through your Internet connection are aware of these Terms and Conditions, and that they comply with them.

    It is your responsibility as a User to review the Terms and Conditions periodically. If at any time you do not agree with the Terms and Conditions, we ask that you refrain from using this Site or any of its applications.

  4. Scope of Service:

    4.1. Ibibo acts as an intermediary in the purchase of Bus Tickets/Tickets between the User and the Bus Operator through the Website, as well as through the mobile applications that link to the Website. Additionally, Ibibo, through the Website, makes the Payment Facilities available to the User so that they can comply with the payment obligation derived from the execution of the Transport Contract.

    In accordance with the above, the Transport Contract is entered into by the User and the Bus Operator, and, therefore, the rights, obligations and responsibilities derived from said contract will be the responsibility of the parties to said agreement of wills, therefore , neither Ibibo nor the Website are part of, and, therefore, they do not acquire rights, contract obligations or assume responsibilities derived from the Transport Contract.

    4.2. Neither Ibibo nor the Website sell, market or distribute Tickets/Tickets, since their work is limited through the Website, making the Payment Facilities available to the User, so that they comply with the obligation to buy derived from the execution of the Transport Contract.
    Therefore, it is worth stating thati Ibibo, nor the Website issue Tickets/Tickets, since, a time the Transaction is carried out on the Website, a is issued sales receipt with the minimum data of the service contracted by the User from the Transport Operator, which are, among others, but not limited to:

    4.3. Ibibo and the Website will respond to the User for what corresponds to them in relation to the use of the Payment Facilities.

    In any case, the Website will serve as a channel to process all requests, complaints, claims and cancellations raised by the User related to the Transportation Contract before the Bus Operator, derived from a Transaction, in accordance with what is established for this purpose. in these terms and conditions, as well as in the PQRs policies of the Website.

    Likewise, the Website will process the requests, complaints, claims and cancellations raised by the User related to the Payment Facilities, directly, or before the payment gateway, the collector or any system, means or payment mechanism, derived from a Transaction, in accordance with what is established for this purpose in these Terms and Conditions, as well as in the PQRs policies of the Website.

    4.4. When the User makes the purchase of any of the services included in the App or Website owned by Ibibo, and this is confirmed by the banking entity, Ibibo will charge the value corresponding to the management carried out, which will be understood, among other things, , but not limited to this, the maintenance and use of the platform, the intermediation for the sale of tickets, administration of the service, among others. Value that will be shown to the User in the interface of each Transport Operator, as well as in the Boucher summary of the trip.

    Therefore, the User accepts, knows and understands the above when accepting these Terms and Conditions and also recognizes that this value is NON-refundable, in the cases that apply.

    4.5. New Services or Additional Services: That Ibibo may include new services on its Website, which will be those offered by each Transport Operator autonomously and provided that the contractual link exists between Ibibo and it.

    Therefore, within the municipal and inter-municipal transport service provided by the Transport Operator through integration into the RedBus platform, it gives the alternative that Users, at their free choice and for a greater value, can include within their trip to be made, different recreation and tourism activities such as, among others, but not limited to: food packages to the destination where you are going, stay packages, recreation and tourism packages.

    The Tourism Operator is then in charge of providing feedback and updating the RedBus platform in accordance with costs, schedules, availability dates, recommendations, confirmations, new alliances, unavailable activities, among others, so that RedBus can clearly offer its Users the conditions of the services to be provided by the Transport Operator, RedBus then continuing with its intermediation activity between the Transport Contract signed by the User and the Transport Operator.

    In any case, the User will consult the Terms and Conditions of the Transport Operator responsible for the provision of these additional services in order to know and understand their scope.

  5. User Account:

    Ibibo may offer the User the option of opening a user account on the Website. Said account will require the User to provide a valid cell phone number that will allow the account to be authenticated and in which they will receive messages related to said account. The User who opens a user account on the Website under this procedure will be called Registered User. Likewise, a User may carry out a Transaction on the Website without having to be registered (Unregistered User).

    All Users who want to obtain the benefit established in the Redbus Wallet program must be registered users. In relation to your account on the Website and, the User must:

    1. The User is responsible for maintaining the confidentiality of his/her account and password, and restricting access to his/her computer in order to prevent unauthorized access to his/her account when using the Website as a registered user.
    2. By using the Website, whether as a guest user or registered user, the User authorizes Ibibo and its agents and related parties to access third-party sites, including those of financial entities and/or banks or other payment gateways designated by financial entities and /or banks, or on behalf of financial entities and/or banks, in order to recover or complete the information requested for the processing of a transaction generated by the User on the Website.
    3. By accepting these Terms and Conditions, the User who uses the Website through a registered account accepts responsibility for all activities that occur under his or her account or password.
    4.     6. Ibibo will not be responsible for detecting, censoring or monitoring Transactions, nor will it be responsible for determining whether the Transaction is legal and valid in accordance with the laws of the User's country of origin.
    7. The User will respect and comply with the current Terms and Conditions. Likewise, the User will abide by all applicable laws and regulations related to the use of the Website.
    8. The Website and the mobile applications linked to it may be used only for personal and non-commercial purposes. Therefore, the User is not authorized to resell, link to secondary pages, use, copy, monitor (for example, with spider, scrape, etc.), display, download or reproduce any content or information, software, product or Payment Facilities available on the Website for any commercial or competitive activity or purpose.
    9. Ibibo reserves the right to deny access to the Website, cancel accounts, remove or edit content at any time, without giving notice, if it has a reasonable conviction that an account is being used for unauthorized purposes.
  6. Privacy:

  8. User Conduct:

The User has only a limited right to use the Website, and is not authorized to modify any part of the Website or to reproduce, copy, distribute, sell, resell, access, among others, the services provided by the Website to any commercial, operational, illicit purpose and/or that may modify the normal use of the Website or that may confuse or dissuade other Users.

    3. In the event of any illegal, fraudulent or contrary conduct to these Terms and Conditions, Ibibo may cancel the Transaction, and if required, return the money or make it available to the authorities.
    4. The User may not use any meta tag or any other hidden text using the Website or the names or trademarks of its affiliates without the express written consent of Ibibo or its affiliates, as applicable.
  9. Purchase modifications by the User:

    For the purposes of these Terms and Conditions and in the event that the relationship between the User and Ibibo remains in force, the User may carry out at any time, but always when it occurs prior to the provision of the service by the Transport Operator and is within the deadlines that each of these has defined, may request changes with respect to the destinations, the calendar, the contracted trip itinerary or any other situation concerning the benefits and, the transportation service provider (Bus Operator). may carry them out, demanding (if applicable) the payment of the justified additional expenses that said modification would have caused as well as compensation for modification of the reservation, which will be established by each of the companies providing the transportation service under its authority.

    In cases where the Bus Operator is forced to make significant changes, it will immediately inform the passenger, applying its internal policies.

    Therefore, the User understands that the effects that the modifications requested by the User may cause are unrelated and do not generate any responsibility or obligation on the part of Ibibo.

  10. Restrictions:

    The User may not use the Website to:

    1. Fraudulent purposes or in relation to conduct classified as criminally reprehensible or other illegal activity.

    2. Send, use, reuse any material that does not belong to you, material that is illegal, offensive, including, but not limited to: material whose content is sexually explicit or that promotes racism, bigotry, hatred or physical harm, misleading, that is misleading, abusive, indecent, harassing, blasphemous, defamatory, libelous, obscene, pornographic, paedophilic, threatening, ethically objectionable, disparaging, infringing of copyright, trademark, confidentiality, privacy or any other information or property right, that is harmful to third parties, is related to, or promotes money laundering, gambling, betting, is in any way harmful to minors, impersonates another person, threatens the unity, integrity , security or sovereignty of Colombia or friendly relations with foreign States.   11. Communications:

    When the User uses the Website or sends emails, information, communications or other data to Ibibo, the User authorizes Ibibo to respond and send communications, including periodically, through any means.

    The User may be asked for a valid telephone number while processing an order or conducting a Transaction on the Website. By registering their telephone number on the Website, the User authorizes being contacted by Ibibo regarding the Transaction on the Website.

  12. Redbus Wallet:

    Users who are part of the Redbus Wallet program must take into account:

    1. Users will have a wallet as long as they have an account created;

    2. The Wallet is personal in nature and you cannot use it for other people or other uses other than those mentioned here.

    3. The User will earn money in his or her wallet for: (i) purchases made on the Website or App and the promotion or publication expressly states the amount of value that the User acquires in his or her wallet on the occasion of it; (ii) by referring and sharing other Users so that they can use the RedBus Services; and (iii) for authorizing Ibibo to make the value corresponding to the returns in your wallet, as long as applicable.

    4. Once Ibibo deposits the value corresponding to the effective purchase into the User's wallet, which corresponds to points, where one point is equivalent to one thousand pesos ($1,000) legal currency, the balance corresponding to this will be valid for 90 days counted from from that moment on; If it is not used within this period, it will expire and the User will not be able to use it.

      The term established in this section may be changed by Ibibo without requiring a modification to these Terms and Conditions.

    5. When the User generates a payment pin on the Website to complete the Transaction through means such as Efecty or Su Red, and does not make the effective payment through these mechanisms, it will be understood that the points, nor the balance, were never generated. that due to the respective Transaction would have been generated on the occasion of the Redbus Wallet program.

    6. The User may only make the payment of the Ticket that completes the Transaction with a part of their balance in the wallet, for which it will be the equivalent of ten percent (10%) of the total value of the transaction actually carried out.
  13. Exemption of Guarantees and Liability:

    Ibibo, despite making available different technological means for the provision of Intermediation services between the Bus Operator and the User, and using its highest degree of diligence, in accordance with the provisions of the Colombian Civil Code, does not guarantee and therefore, will not be responsible, among other things, but without limitation, because:

    1. The Website is constantly available, or available at all times;

    2. The information, content, materials, software, Payment Facilities, as they are services provided by third parties that have their own policies, management and security, beyond our control, or the services included in the Website, on their servers. , in electronic communication systems, among others, are free of viruses or other harmful components, although we use our best efforts to prevent these incidents;

    3. The Website nor Ibibo is responsible for the failure of the Bus Operator with respect to the execution of its obligations, nor for unforeseen events caused, such as, among others, but not limited to unilateral modifications, public order strikes, weather conditions, delays. , earthquakes, quarantines, cases of public health and/or health emergencies, as well as for material and moral damages that the User may suffer due to the loss, damage or theft of luggage, or for accidents, illnesses or deaths that occur on the occasion of the provision of the service, even more so, when these activities are not carried out by us directly or indirectly.

      The passenger accepts that if any of the events listed in the previous point occur, they must complain directly to the companies providing the unfulfilled service. We will provide our collaboration as soon as possible.
  14. Responsibility regarding the Trip:

    As mentioned above, neither Ibibo nor the Website are parties to the Transportation Contract entered into by the User and the Bus Operator. Their job is to be an intermediary to put the parties to said contract in contact. Under this understanding, neither Ibibo nor the Website can be responsible for compliance with the obligations that correspond to the parties in the aforementioned Transportation Contract, of which it is not a Party and therefore, they are not responsible, among other things, but without limitation. to this, by:

    1. That the Bus Operator's vehicle does not leave and/or arrive on time.
    2. For changes in arrival time caused by road closures, weather conditions or cases of force majeure, fortuitous event or act of a third party.
    3. That the Bus Operator cancels the trip for reasons of force majeure or unforeseeable event.
    4. For the loss, theft or damage of the User's luggage.
    5. That the passenger does not show up at least one (1) hour before the trip on the date and place of boarding, which is considered by the Bus Operator as a withdrawal from the Transportation Contract.

    This is because the Bus Operator is the sole owner of this type of information and therefore, is the one who knows, manages, administers it, among others, having the responsibility before Ibibo to keep us updated and before the User by giving him the information. clear, precise and complete, in the interest of consumer protection.

  15. Responsibility regarding Payment:

    Ibibo provides Payment Facilities through the Website through third parties for the User to carry out a Transaction. In any case, neither Ibibo nor the Website in relation to the Payment Facilities are responsible for:

    1. That the User exceeds the pre-established amount or time limit and mutually agreed with their banks or financial entities.
    2. That the transaction is declined for any reason, without Ibibo or the Website having responsibility.
    3. That the User does not have space to carry out the Transaction.
    4. The User accepts and understands that they will have up to a maximum of fifteen (15) minutes to carry out the banking operation on the Website or Application, otherwise, the system, for security reasons, will automatically remove them and they will lose all the data entered with occasion to the reservation and therefore, you must start the process again.
  16. User statements regarding payment:

    With the authorization of the Terms and Conditions, the User in relation to the payment states:

    1. That you have authorized Ibibo and the Website to use the mechanisms or methods that make up the Payment Facilities to collect, process, facilitate and remit the payment derived from the Transaction.

    2. That you know and accept that the payment provided through any third party on the Website is neither a banking nor a financial service, but merely a facilitator that makes available the different means of Payment for the Transaction to be carried out.

      The Payment Facilities use authorized banking infrastructure and credit card payment gateway networks.

    3. That you know and accept that there is a minimum amount to make the payment of the transaction with some payment methods, which will be the equivalent of twenty thousand pesos ($20,000) legal currency.
  17. Right of Withdrawal:

    In relation to a Ticket for which payment has been made through a Transaction, the User may make use of the Right of Withdrawal which is stipulated in the Consumer Statute.

    Therefore, Law 1480 of 2011, Article 47, stipulates that:

    “In all contracts for the sale of goods and provision of services through financing systems granted by the producer or supplier, sale of timeshares or sales that use non-traditional or distance methods, which by their nature should not be consumed or have not begun be executed within five (5) days, the right of withdrawal by the client will be deemed to have been agreed upon. In the event that the right of withdrawal is used, the contract will be terminated and the money that the consumer would have paid must be refunded. .

    The maximum term to exercise the right of withdrawal will be five (5) business days from the delivery of the good or the conclusion of the contract in the case of the provision of services…”

    It is important to state that in cases where the User requests a change in the service, Ibibo will do so under the same conditions and on the dates and times that the User indicates, but, if the request is the return of money, Ibibo will proceed to reintegrate as follows:

    The figure of the “right of withdrawal” does not apply in the following cases:

  18. PQR Care Policy:

    Any request, request, requirement or complaint will be processed in accordance with the procedure and PQR policies that are located on the Website. and in the following direct link ________________, to which you will be directed when you click.

  19. Shipping Policy:

    Neither Ibibo nor the Website are parties to the Transport Contract nor do they sell Road Bus Tickets/Tickets, however, the User must take into account that most Bus Operators reserve the right to deny the passenger the service. of road bus transportation when:

    1. Carrying contraband, illegal substances, fragile or oversized/excessive weight luggage, undisciplined behavior, alcohol intoxication or any other behavior that affects the comfort or safety of other passengers.
    2. Fail to show valid identification while traveling.
    3. Has purchased the Passenger/Ticket without having the capacity, in accordance with the Terms and Conditions.
    4. You have acquired the Passenger/Ticket in an illegal, fraudulent or deceptive manner.
    5. Does not comply with the Bus Operator's policies regarding ages minimum to travel minors, which is explained in more detail in the following section of these Terms and Conditions.
    6. You have made the payment for the Fare/Ticket with a credit card reported as lost or the sacrifice.
    7. Do not provide a valid and legible Passenger/Ticket for the intended trip. The Passenger/Ticket constitutes an element of proof of the Transport Contract entered into between the Bus Operator and the User.
    8. Be deemed medically unable to travel, because you may pose a threat to the health of other passengers on board.
    9. Do not arrive on time to board the bus, or fail to board the bus at the time it is going to leave.
    10. If the bus operator has refused to transport it or chooses to remove it from its unit in accordance with the aforementioned reasons, it will cancel its Ticket, without the User having the right to no type of refund or reissuance of the Ticket.

    In cases where the Transport Operator applies any of the previous paragraphs to the User, the User understands and accepts that he/she will carry out any type of PQR's directly to the Transport Operator in its service channels and not to Ibibo as it has no responsibility.

  20. In relation to the transportation of “minors”, Bus Operators establish that:

    1. Children over two (2) years old occupy a seat and will pay a ticket.
    2. Children under twelve (12) may only travel accompanied by an adult.
    3. Children 12 years of age and older may travel unaccompanied; The Bus Operator may request the identification document to verify the age of the minor. Any child under 18 years of age traveling unaccompanied must be transported with the corresponding travel permit, for which the authorization must be completed, attaching a copy of the identity document of the person authorizing and the minor. and following the guidelines that the Transport Operator indicates for these cases, always in compliance with the provisions of Colombian regulations, such as the civil code, instructions issued by the Superintendence of Transportation, national code of security and citizen coexistence, among others..
  21. Cancellation Policy:

    On the Website the User will have access to the cancellation policies of the Bus Operator with which he or she celebrates the Transport Contract. If the User requires more information about the cancellation policies of a Bus Operator, they may request that it be sent by email, for which the procedure will be followed and the PQR policies of the Website will be followed.

    To cancel a trip whose payment has been made through a Transaction, the User must initiate the cancellation process from the Website or application, selecting the Cancellation option: www.redbus.co/Cancellation.

    If cancellation is not enabled, review the bus company's refund policies. If it meets these parameters, write to us at notificaciones.co@redbus.com, indicating that it is a trip cancellation. Ibibo's service hours to proceed with this request are Monday to Friday from 8 a.m. to 5 p.m. to 9 p.m. and on Saturdays and Sundays from 9 a.m. to 6 p.m. to 6 p.m.

    Ibibo will contact the Bus Operator so that they can cancel in accordance with their cancellation policies. Ibibo will inform the User of the Bus Operator's response regarding their trip cancellation request.

  22. Refund Policy:

    RedBus has implemented the following Refund policies to apply:
    22.1 The Client / User by accepting these Terms and Conditions, will have the right, in cases where the Right of Withdrawal, as described in section 17 of these Terms and Conditions and as provided by the Consumer Statute, to a refund corresponding to one hundred percent (100%) of the value paid for the Ticket/Ticket if the cancellation or impossibility of making the trip, once the Transaction has been completed, is attributable to an error or negligence on the part of Ibibo or the Bus Operator, and will be assumed by the person who made the mistake or acted negligently.

    Cancellation or impossibility of making a trip are excluded from refund when the circumstances that motivated it are attributable to the User, to an event of fortuitous event or force majeure or to the act of a third party. The value stipulated in section 4.4 will not be refunded. of these Terms and Conditions.
